About the ZBA

A Zoning Map Amendment (rezoning) will rezone the district classification of a specific geographic area on a zoning map. A zoning change may address part of a parcel, single parcels or multiple parcels. An example may be changing a parcel from an office zoning district (which would only permit offices) to a commercial zoning district (which would permit offices and businesses.)

Time required: Average time required to complete a rezoning request varies between 60 to 90 days. The petitioner should consult the Planning Department for advice regarding the feasibility of the intended rezoning, the zoning classification most appropriate for the intended use and conformance with the adopted Land Use Plan.
Procedure: Petitioner submits petition for Zoning Map Amendment (Rezoning) to the Planning Department along with a $420 filing fee. Check must be made payable to the Village of Springport.

  • Fill out the Petition for Zoning Map Amendment (rezoning).
  • Planning Commission and the Village of Springport sets a public hearing date for the petition and places a notice of the hearing in the newspaper at least fifteen (15) days prior to the date of hearing.
  • All property owners within three hundred (300) feet of the subject property are notified of the public hearing by First-Class Mail.
  • Planning Commission conducts a public hearing.
  • Planning Commissions recommends approval, denial or modified approval to the Village Council within sixty (60) days of the public hearing.
  • Village Council receives the recommendation and proposed ordinance from the Planning Commission.
  • The Council gives first reading of the proposed ordinance to amend the zoning map, and sets the date for public hearing.
  • Notice of the public hearing is placed in the newspaper at least fifteen (15) days prior to the date of the public hearing.

Zoning Fees

UPON ADMINISTRATIVE REVIEW OF THE APPLICATION AND SITE PLAN, THE FOLLOWING FEES WILL APPLY IF ADDITIONAL REVIEW IS REQUIRED, SUCH AS, DETAILED SITE PLAN REVIEW, VARIANCE, AND CONDITIONAL USE, FROM THE ZONING ORDINANCE.

1. Rezoning request to the Zoning Ordinance Text including variance – $800(Plus any additional cost incurred)
2. Planned Residential Development – $1500 Engineering fees-based on cost of development. (if applicable plus any additional cost incurred)
3. Appeals to the Zoning Board of Appeals – $980 (plus any additional cost incurred)
4. Issuance of zoning compliance permits – $150
5. Conditional Use Permit – $500
6. Special Land Use – $500
7. Site Plan Review, Industrial/Commercial – $750 Engineering fees-based on cost of development (plus any additional cost incurred)
8. Site Plan Review, Residential – $250 Engineering fees-based on cost of development (plus any additional cost incurred)
9. Zoning Inquiries – $150 (plus any additional cost incurred)

IF CONSTRUCTION IS STARTED PRIOR TO OBTAINING A ZONING APPLICATION, THE FEE WILL BE TRIPLED. THE APPLICANT WILL ALSO BE BILLED FOR THE COST OF A PUBLIC HEARING; NOTICE PUBLISHED; AND NOTICES MAILED OUT TO PROPERTY OWNERS, (IF APPLICABLE). THE ABOVE FEE SCHEDULE DOES NOT INCLUDE FEES FOR BUILDING PERMIT AND/OR INSPECITON, ELECTRICAL OR PLUMBING INSPECTIONS.
